{"data":{"id":"us-ky/krs-286.13-145","jurisdiction":"us-ky","citation":"KRS 286.13-145","heading":"Commissioner may issue order and levy civil penalty.  (Effective April","body":"30, 2027)\n(1) As used in this section, \"person\" means any applicant, licensee, virtual currency\nkiosk operator, agent, or other person.\n(2) Subject to KRS 286.13 -125, the c ommissioner may do one (1) or more of the\nfollowing:\n(a) Issue an order against any person to:\n1. Refund any amount charged or collected in violation of this subtitle; or\n2. Pay any fee or civil penalty, or provide any other remedy, authorized\nunder this subtitle;\n(b) Levy a civil penalty against any person that violates, or participates in the\nviolation of, any:\n1. Provision of this subtitle;\n2. Administrative regulation promulgated under this subtitle;\n3. Order issued under this subtitle; or\n4. Agreement with the commissioner relating to compliance with this\nsubtitle; and\n(c) For any virtual currency kiosk operator or its agent that is subject to a civil\npenalty under paragraph (b) of this subsection, issue  an order directing any\npeace officer to:\n1. Seize or impound the operator's or agent's virtual currency kiosk,\nincluding any contents thereof; or\n2. Render the operator's or agent's virtual currency kiosk inoperable.\n(3) The civil penalty levied under subsection (2)(b) of this section:\n(a) Shall be not less than one thousand dollars ($1,000) nor more than five\nthousand dollars ($5,000) per violation; and\n(b) May:\n1. Be assessed for each day the violation is outstanding; and\n2.
