{"data":{"id":"us-ky/krs-286.2-105","jurisdiction":"us-ky","citation":"KRS 286.2-105","heading":"Examination of contents of a decedent's safe deposit box to find will or","body":"funeral arrangements -- Definitions for section.\n(1) As used in this section:\n(a) \"Interested person\" means a:\n1. Lessee's surviving spouse, adult child, or parent;\n2. Person named as the personal representative in a copy of a purported\nwill of a lessee produced by the person;\n3. Person designated by a lessee in a writing that is:\na. Acceptable to a lessor; and\nb. Filed with a lessor before the death of a lessee; or\n4. Person named in a court order to examine the contents of a safe deposit\nbox for any purpose listed in subsection (2) of this section;\n(b) \"Lessee\" means a person who contracts with a lessor for the use of a safe\ndeposit box;\n(c) \"Lessor\" means any of the following entities that rent safe deposit boxes:\n1. A state or national bank, bank holding company, trust company, savings\nand loan associa tion, savings and loan association holding company,\ncredit union, or wholly owned subsidiary of any of the foregoing; or\n2. A safe deposit company; and\n(d) \"Safe deposit box\" means a safe deposit box, vault, receptacle, or other safe\ndeposit facility maint ained by a lessor that may be used for the safekeeping\nand storage of property and documents.\n(2) (a) If an interested person presents satisfactory proof of the death of a lessee and\nthe interested person possesses a key to the lessee's safe deposit box, a  lessor\nshall permit the interested person to open and examine the contents of the safe\ndeposit box in the presence of an employee of the lessor for any or all of the\nfollowing purposes:\n1. To conduct a will search; or\n2. To obtain any document purporting to:\na. Be a deed to a burial plot; or\nb. Give funeral or burial instructions.\n(b) For purposes of this subsection, the following shall be considered satisfactory\nproof of the death of a lessee:\n1. A death certificate;\n2. A notice or indication of death fro m a governmental agency, funeral\nhome, or hospital; or\n3. Any other document that a reasonable person would rely on as an\nindication of death.\n(3) If a safe deposit box is opened for any or all of the purposes listed in subsection (2)\nof this section, an employee of the lessor shall remove any document that appears to\nsatisfy the purpose or purposes, make a true and correct machine copy thereof,\nreplace the copy or copies in the box, and then deliver the original document or\ndocuments to the interested person requesting the search.\n(4) This section shall not be construed to authorize the removal of any safe deposit box\ncontents other than a will, a document purporting to be a deed to a burial plot, and a\ndocument giving funeral or burial instructions.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55139","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:10Z","sha256":"b466ff0c2c802e62b54fb5f074e58d11a44c77ae8247074aa6dde2a0ec0bbfc5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.2-100","next":"us-ky/krs-286.2-670"},"notice":"GroundRules: Original legal text.
