{"data":{"id":"us-ky/krs-286.3-102","jurisdiction":"us-ky","citation":"KRS 286.3-102","heading":"Activities permitted to state bank receiving CAMELS rating of 1 or 2 --","body":"Section not applicable to deferred deposit transactions or title pledge lending.\n(1) As used in this section, a CAMELS rating means a system of rating used by\nexaminers of financial institutions to rate the institutions in six (6) categories:\ncapital adequacy, asset quality, management effectiveness, quantity and quality of\nearnings, liquidity, and sensitivity to market risk.\n(2) In addition to all other banking activiti es permitted by this subtitle, a state bank\nreceiving a CAMELS rating of 1 or 2 at its most recent state or federal bank\nregulatory examination may engage in any banking activity in which the bank could\nengage and is exempted from any statutes or administr ative regulations which\nwould be preempted if:\n(a) It was operating as a national bank in Kentucky;\n(b) It was operating as a state bank, state thrift, or state savings bank in any state;\nor\n(c) It meets the qualified thrift lender test as determined by th e Office of Thrift\nSupervision or its successor, or was operating as a federally chartered thrift or\nfederal savings bank in any state.\n(3) Before a state bank may engage in any of the banking activities permitted by\nsubsection (2) of this section, the sta te bank shall obtain a legal opinion specifying\nthe statutory or regulatory provisions that permit the activity in which the state bank\nintends to engage and the conditions under which such activity is allowed. This\nlegal opinion shall be maintained by the  bank and provided to the department upon\nrequest.\n(4) This section shall not apply to exempt any laws which regulate Kentucky state\nbanks pertaining to deferred deposit transactions in Subtitle 9 of this chapter,\nvisitorial or examination powers, and interest rates.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55166","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:10Z","sha256":"bcf517618f977803480bcd00dd2cc7fc29a6480132e41b42021f718ce3feb6f4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.3-101","next":"us-ky/krs-286.3-103"},"notice":"GroundRules: Original legal text.
