{"data":{"id":"us-ky/krs-286.3-270","jurisdiction":"us-ky","citation":"KRS 286.3-270","heading":"Fiduciary may act in own name -- Records -- Investments not subject to","body":"debts of fiduciary.\n(1) In making real estate mortgage loans for the purpose of investing trust funds, a trust\ncompany or bank empowered to act as a fiduciary may make such mortgage loans in\nits individual name, and in connection with such loans may prosecute all suits and\nforeclosure actions, and may buy in, manage, lease, repair, and sell foreclosed\nproperty in its individual name, without reference to any trust or beneficial\nownership.\n(2) Such trust company or bank shall at all times keep definite records showing fully\nand accurately all beneficial ownership in such loans, suits, or property, which\nrecords shall at all times be subject to the inspection and examination of eith er state\nor federal banking authorities.\n(3) Such mortgage loans and foreclosed property shall not be subject to the individual\ndebts of the trust company or bank but shall belong to the beneficial owners thereof\nas shown by the records free from any claims against the trust company or bank.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14568","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:10Z","sha256":"a6f47739619aff59645ec79dc0b53fd1fa23da4bf02550ff08d754021a959c11","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.3-260","next":"us-ky/krs-286.3-272"},"notice":"GroundRules: Original legal text.
