{"data":{"id":"us-ky/krs-286.3-375","jurisdiction":"us-ky","citation":"KRS 286.3-375","heading":"Preservation of bank records.","body":"(1) Every bank shall retain its business records for such periods as are or may be\nprescribed by or in accordance with the terms of this section.\n(2) Each bank shall retain permanently the minute book of meetings of its stockholders\nand directors, its capital stock ledger and capital stock certificate ledger or stubs, its\ngeneral ledger, its daily statements of condition, its general journal, its investment\nledger, its copies of bank examination reports, and all records which the\ncommissioner shall, in accordan ce with the terms of this section, require to be\nretained permanently.\n(3) All other bank records shall be retained for such periods as the commissioner shall,\nin accordance with the terms of this section, prescribe.\n(4) The commissioner shall from time to  time issue regulations classifying all records\nkept by banks and prescribing the period for which records of each class shall be\nretained. Such periods may be permanent or for a lesser term of years. Such\nregulations may from time to time be amended or re pealed. Prior to issuing any\nsuch regulation the commissioner shall consider:\n(a) Actions at law and administration proceedings in which the production of\nbank records might be necessary or desirable;\n(b) State and federal statutes of limitation applicable  to such actions or\nproceedings;\n(c) The availability of information contained in bank records from other sources;\n(d) Such other matters as the commissioner shall deem pertinent in order that its\nregulations will require banks to retain their records for as short a period as is\ncommensurate with the interests of bank customers and shareholders and of\nthe people of this state in having bank records available.\n(5) Any bank may dispose of any record which has been retained for the period\nprescribed by or in accordance with the terms of this section for retention of records\nof its class, and shall thereafter be under no duty to produce such record in any\naction or proceeding.\n(6) Any bank, including the Department of Financial Institutions, may cause any or all\nrecords at any time in its custody to be reproduced by the microphotographic\nprocess, nonerasable optical image discs (CD's), or other records retention\ntechnology approved by the department, and any reproduction so made shall have\nthe same force and effect as the original thereof and be admitted in evidence equally\nwith the original.\n(7) To the extent that they are not in contravention of any law of the United States, the\nprovisions of this section shall apply to all banks doing business in this state.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14580","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:10Z","sha256":"b18acef566690eb7f0f64a801a2f930e200b82f2ee9532010ad358134e1d2207","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.3-350","next":"us-ky/krs-286.3-380"},"notice":"GroundRules: Original legal text.
