{"data":{"id":"us-ky/krs-286.3-470","jurisdiction":"us-ky","citation":"KRS 286.3-470","heading":"Information obtained by examination to be confidential -- Exceptions --","body":"Reports as evidence.\n(1) Reports of examination, and correspondence that relates to the report of\nexamination, of a bank or trust company shall be considered confidential\ninformation. No officer or director of a bank or trust company, employee of the\ndepartment, or employee of a state or federal regulatory authority shall release any\ninformation contained in the examination, except when:\n(a) Required in a proper legal proceeding in which a subpoena and protective\norder insuring confidentiality has been issued by a court of competent\njurisdiction; or\n(b) The information is referred to an appropriate prosecuting attorney for possible\ncriminal proceedings, to outside persons providing professional services to the\nbank, or to outside persons for the purpose of evaluating the bank for possible\nacquisition. Reports of examination released to outside persons providing\nprofessional services to the bank or for the purpose of evaluating the bank for\npossible acquisition, shall require a written request from such outside persons\nand prior approval by the board of directors or an executive committee of the\nbank.\n(2) The department may furnish to and exchange information and reports with officia ls\nand examiners of other properly authorized state or federal regulatory authorities,\nincluding the Federal Deposit Insurance Corporation, the Federal Reserve Board,\nand the Office of the Comptroller of the Currency.\n(3) Every official report concerning a  bank or trust company, and every report of\nexamination, shall be prima facie evidence of the facts therein stated for all\npurposes in any action in which the department, bank, or trust company is a party.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14587","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:10Z","sha256":"706fe94d13299f31de8b725b3d0c5749e992f367bf060594933530b804190c2b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.3-460","next":"us-ky/krs-286.3-480"},"notice":"GroundRules: Original legal text.
