{"data":{"id":"us-ky/krs-286.4-500","jurisdiction":"us-ky","citation":"KRS 286.4-500","heading":"Notice of license denial -- Administrative complaint -- Hearings and final","body":"orders -- Findings -- Service by certified mail.\n(1) (a) Notice of entry of any order denying a license shall be in writing and served\npersonally or sent by certified mail to the last known address of the applicant.\n(b) A person whose application has been denied may, within twenty (20) days of\nservice of the notice, submit a written petition to the commissioner requesting\na hearing. The hearing shall be held in accordance with KRS Chapter 13B.\n(c) If no written petition is received, the commissioner may enter a final order\ndenying the license.\n(2) (a) The commissioner may file an administrative complaint against any person or\nlicensee that the commissioner believes has o r may have violated this subtitle\nand the violation of which is subject to the penalties set forth in KRS 286.4 -\n490 or 286.4-990.\n(b) 1. The commissioner shall serve an administrative complaint against a\nperson or licensee personally or by certified mail, return receipt\nrequested, postage prepaid, to the last known address of each person or\nlicensee named in the complaint.\n2. The person or licensee named in the complaint shall be entitled to a\nhearing on the complaint, held in accordance with KRS Chapter 13 B. A\nwritten request for a hearing shall be submitted to the department, along\nwith a written answer to the complaint, within twenty (20) days of being\nserved the complaint.\n3. If a written answer and request for hearing are not filed within twenty\n(20) days of being served the complaint, the person or licensee shall be\ndeemed to have waived the hearing and the commissioner may enter a\nfinal order granting the relief requested in the complaint.\n(3) Whenever the commissioner denies any application for a lice nse or assesses any of\nthe penalties set forth in KRS 286.4 -490 or 286.4 -990, the commissioner shall file\nin his or her office a written order to that effect, stating his or her findings with\nrespect to the order and the reasons for the action.\n(4) Any final order shall be served in the same manner as an administrative complaint\nunder subsection (2) of this section.\n(5) Service by certified mail under this subtitle shall be deemed complete as provided\nin KRS 13B.050(2).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48942","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:11Z","sha256":"465f234460ee836710a97b57062c50cfb79730078895be29a3e73d980e6c73b0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.4-495","next":"us-ky/krs-286.4-505"},"notice":"GroundRules: Original legal text.
