{"data":{"id":"us-ky/krs-286.8-036","jurisdiction":"us-ky","citation":"KRS 286.8-036","heading":"Rules concerning use of license -- Alternate work location.","body":"(1) As used in this section:\n(a) \"Documents\":\n1. Means documents involved in the mortgage lending process; and\n2. Includes but is not limited to:\na. Uniform residential loan applications or other loan applications;\nb. Appraisal reports;\nc. Settlement statements;\nd. Supporting personal documentation for loan applications,\nincluding:\ni. Form W-2 or other earnings or income statements;\nii. Verifications of rent, income, and employment;\niii. Bank statements;\niv. Tax returns; and\nv. Payroll stubs;\ne. Any required mortgage-related disclosures; and\nf. Any other document required as a part of, or necessary to, the\nmortgage lending process; and\n(b) \"Employee\" shall include a mortgage loan originator engaged as an\nindependent contractor.\n(2) Each license issued under this subtitle shall state the:\n(a) Address or addresses at which business is to be conducted;\n(b) Name of the licensee; and\n(c) Date and place of its incorporation, if applicable.\n(3) A license may not be transferred or assigned without the prior written approval of\nthe commissioner.\n(4) No licensee shall transact the business provided for by this subtitle under any other\nname or maintai n an office at any location other than a licensed location or an\nalternate work location.\n(5) Every licensed mortgage loan company or mortgage loan broker shall notify the\ncommissioner, in writing, within ten (10) days of the closing of any licensed office\nor registered Kentucky branch.\n(6) A licensee may permit employees to engage in the mortgage lending process at an\nalternate work location if:\n(a) The licensee has written policies and procedures for supervision of employees\nworking from alternate work locations;\n(b) Access to the licensee's computer systems and customer information is in\naccordance with the licensee's comprehensive written information technology\nsecurity plan;\n(c) Employees are not permitted to conduct in -person customer activities at the\nalternate work location except as provided in KRS 286.8-010(2)(b)2.;\n(d) The licensee ensures that no physical or electronic documents are maintained\nat the alternate work location; and\n(e) No signage or advertising of the licensee or the mortgage loan or iginator is\ndisplayed at any alternate work location.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52850","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:14Z","sha256":"7d6c21cce9311b6f09479a38bb53fb6efac533c009af9ede3f99e7982ff404fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.8-034","next":"us-ky/krs-286.8-038"},"notice":"GroundRules: Original legal text.
