{"data":{"id":"us-ky/krs-286.8-044","jurisdiction":"us-ky","citation":"KRS 286.8-044","heading":"Notice of order in writing -- Administrative complaint -- Service --","body":"Hearing.\n(1) Notice of entry of any order of suspension or denial of a license, registration, or\nclaim of exemption to any applicant, registrant, or licensee shall be given in writ ing\nand served personally or sent by certified mail to the last known address of the\nperson affected. The affected person, upon timely written request to the\ncommissioner, shall be entitled to a hearing in accordance with the provisions of\nKRS Chapter 13B;  but if no written request is received within twenty (20) days of\nservice of the notice, the commissioner shall enter a final order suspending or\ndenying the license or registration.\n(2) The commissioner may file an administrative complaint against any per son if it\nappears on grounds satisfactory to the commissioner that a potential or actual\nviolation of this subtitle has been committed  and when the person may be subject to\nthe penalties of KRS 286.8-046, 286.8-090, and 286.8-990. The commissioner shall\nserve the administrative complaint by certified mail or personal delivery to the last\nknown address of the person named in the complaint. The person named in the\nadministrative complaint shall be entitled to a hearing, but only upon timely receipt\nof a written answer and request for a hearing within twenty (20) days of the service\nor hand delivery of the administrative complaint. If timely requested, an\nadministrative hearing shall be held in accordance with the provisions of KRS\nChapter 13B. If a written answer and request for hearing are not made within twenty\n(20) days of service or delivery of the complaint, the commissioner shall enter a\nfinal order granting the relief requested in the complaint.\n(3) Service by certified mail shall be complete upon the earlier of the following:\n(a) The date on which the person receives the mail;\n(b) The date on which the agency receives the return receipt; or\n(c) The date on which the agency receives notice that the mail has been returned\nundelivered.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14860","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:14Z","sha256":"7c415955d9f3e231973f1e7d969c7c83c93f11b1dd1ba341ee64bce6076988ac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.8-042","next":"us-ky/krs-286.8-046"},"notice":"GroundRules: Original legal text.
