{"data":{"id":"us-ky/krs-286.8-175","jurisdiction":"us-ky","citation":"KRS 286.8-175","heading":"Confidentiality of examination reports and information -- Exceptions --","body":"Prima facie evidence.\n(1) Reports of examination, and correspondence that relates to the report of\nexamination, of a mortgage loan company or mortgage loan broker shall be\nconsidered confidential information. No officer or director of a mortgage loan\ncompany or mortgage loan broker, employee of the department, or employee of a\nstate or federal regulatory authority shall release any information contained in the\nexamination, except when:\n(a) Required in a proper legal proceeding in which a subpoena and protective\norder insuring confidentiality has been issued by a court of competent\njurisdiction; or\n(b) The information is referred to an appropriate prosecuting attorney for possible\ncriminal proceedings.\n(2) The department may furnish to and exchange information and reports with officials\nand examiners of other properly authorized state or federal regulatory authorities.\n(3) Every official report concerning a mortgage loan company or mortgage loan broker,\nand every report of examination, shall be prima facie evidence of the facts therein\nstated for all purposes in any action in which the department, mortgage loan\ncompany, or mortgage loan broker is a party.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14877","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:14Z","sha256":"58abee6039441c72a75129809f81e11465d7226ee2f3b696e1df3c0689bf1f0d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.8-170","next":"us-ky/krs-286.8-180"},"notice":"GroundRules: Original legal text.
