{"data":{"id":"us-ky/krs-286.8-275","jurisdiction":"us-ky","citation":"KRS 286.8-275","heading":"Reporting of violations of subtitle -- Duties of commissioner -- No waiver","body":"of privilege or claim of confidentiality.\n(1) Any person having knowledge or believing that a violation of this subtitle or any\nother illegal act or practice is being or has been committed may provide the\ncommissioner a report of information pertinent to his or her knowledge or belief\nand any additional relevant information the commissioner may request.\n(2) Documents, materials, or other information in the possession or contro l of the\ncommissioner that is provided according to this section shall be confidential by law,\nprivileged, and shall not be subject to the Kentucky Open Records Act, KRS 61.872\nto 61.884. These documents, materials, or other information shall not be subjec t to\nsubpoena, and shall not be subject to discovery or admissible as evidence in any\ncivil action unless, after written notice to the commissioner and a hearing, a court of\ncompetent jurisdiction determines the commissioner would not be unduly\nprejudiced.\n(3) Neither the commissioner nor any person who received documents, materials, or\nother information while acting under the authority of the commissioner shall be\npermitted or required to testify in any civil action concerning any confidential\ndocuments, materials, or other information subject to subsection (2) of this section.\n(4) In order to assist in the performance of the commissioner's duties, the commissioner\nmay:\n(a) Use the documents, materials, or other information in the furtherance of any\nregulatory or legal action brought as part of the commissioner's official duties;\n(b) Share the documents, materials, or other information, including confidential\nand privileged documents, materials, or other information subject to\nsubsections (2) and (3) of this  section, with other state, federal, and\ninternational law enforcement authorities or the Conference of State Bank\nSupervisors or its affiliate if the recipient agrees to maintain the\nconfidentiality and privileged status of the documents, materials, and o ther\ninformation; and\n(c) Enter into agreements governing the sharing and use of information including\nthe furtherance of any regulatory or legal action brought as part of the\nrecipient's official duties.\n(5) No waiver of any applicable privilege or claim of confidentiality in the documents,\nmaterials, or information shall occur as a result of disclosure to the commissioner\nunder this section or as a result of sharing as authorized in subsection (4) of this\nsection.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14891","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:14Z","sha256":"e1872e67712caf491b1a3d012559e969b3bf38578404a8720de05332cb332a26","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.8-270","next":"us-ky/krs-286.8-280"},"notice":"GroundRules: Original legal text.
