{"data":{"id":"us-ky/krs-286.9-035","jurisdiction":"us-ky","citation":"KRS 286.9-035","heading":"Deferred deposit transaction agreement with unlicensed person void.","body":"(1) Any deferred deposit transaction agreement made with a person who is not licensed\nunder this subtitle shall be void, and the person shall not collect any principal, fee,\ninterest, charges, or recompense whatsoever.\n(2) The commissioner may void a deferred deposit transaction agreement when it is\ndetermined by the commissioner that the licensee has violated any provision of this\nsubtitle. The licensee shall be allowed to recover from the customer any principal\npaid by the licensee to the customer, but the li censee shall not recover any service\nfee or other charge related to the deferred deposit transaction.\n(3) For purposes of this section, \"payment instrument\" also includes debit\nauthorization, electronic funds transfer, and any other form of electronic\ntransmission of money.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14901","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:14Z","sha256":"c683f68d60a87039d4f7155ad340f76fcba452bb85672d8d01d2d27b040c4955","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.9-030","next":"us-ky/krs-286.9-040"},"notice":"GroundRules: Original legal text.
