{"data":{"id":"us-ky/krs-292.313","jurisdiction":"us-ky","citation":"KRS 292.313","heading":"Applicability of specified provisions to sales transactions.","body":"(1) KRS 292.320(1), 292.330, 292.340, 292.450, and 292.480 apply to persons who sell\nor offer to sell when an offer to sell is made in this state, or an offer to buy is made\nand accepted in this state.\n(2) KRS 292.320(1), 292.330, and 292.450 apply to persons who buy or offer to buy\nwhen an offer to buy is made in this state, or an offer to sell is made and accepted in\nthis state.\n(3) For the purpose of this section, an offer to sell or to buy is made in this state,\nwhether or not either party is then present i n this state, when the offer originates\nfrom this state or is directed by the offeror to this state and received at the place to\nwhich it is directed (or at any post office in this state in the case of a mailed offer).\n(4) For the purpose of this section, an offer to buy or to sell is accepted in this state\nwhen acceptance is communicated to the offeror in this state and has not previously\nbeen communicated to the offeror, orally or in writing, outside this state; and\nacceptance is communicated to the offer or in this state, whether or not either party\nis then present in this state, when the offeree directs it to the offeror in this state\nreasonably believing the offeror to be in this state and it is received at the place to\nwhich it is directed (or at any po st office in this state in the case of a mailed\nacceptance).\n(5) An offer to sell or to buy is not made in this state when the publisher circulates or\nthere is circulated on his behalf in this state any bona fide newspaper or other\npublication of general, regular, and paid circulation which is not published in this\nstate, or which is published in this state but has had more than two-thirds (2/3) of its\ncirculation outside this state during the past twelve (12) months, or a radio or\ntelevision program originating outside this state is received in this state.\n(6) Subsections (2), (3), and (4) of KRS 292.320, as well as KRS 292.330 and 292.450\nso far as investment advisers or investment adviser representatives are concerned,\napply when any act instrumental in effecting prohibited conduct is done in this state,\nwhether or not either party is then present in this state.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15535","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"c278682b193ac223d052ea87cf5e55d325baa567f2d968bfa3f57d4582986d3a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.310","next":"us-ky/krs-292.320"},"notice":"GroundRules: Original legal text.
