{"data":{"id":"us-ky/krs-292.322","jurisdiction":"us-ky","citation":"KRS 292.322","heading":"Securities fraud prosecution and prevention fund.","body":"(1) There is hereby created in the State Treasury a trust and revolving fund designated\nas the \"securities fraud prosecution and prevention fund.\"\n(2) The commissioner may designate that all or a portion of the civil fines imposed for\nviolations of this chapte r or administrative regulations, or orders issued pursuant to\nthis chapter, be deposited into the fund established in subsection (1) of this section.\n(3) The fund established by subsection (1) of this section may also receive additional\nstate appropriations, gifts, grants, and federal funds.\n(4) Expenditures from the fund established by subsection (1) of this section may be\nused to assist in criminal prosecution of fraudulent activities under this chapter, for\ntraining and equipment related to prevention, d etection, and investigation of\nsecurities fraud, and for investor education.\n(5) The money deposited into the fund is hereby appropriated for the uses set forth in\nsubsection (4) of this section. Notwithstanding KRS 45.229, any money remaining\nin the fund at the close of any calendar year shall not lapse but shall be carried\nforward to the next calendar year. All interest earned on money in the fund shall be\ncredited to the fund.\n(6) The commissioner is responsible for the distribution of moneys in the fund  and\nshall, in consultation with the Attorney General and local prosecutors, develop and\npromulgate administrative regulations for the use of those moneys.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15537","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"944aef5be9dd1a76a16ea482cf6000dce9a2a504eded4974160985c3a0b4c436","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.320","next":"us-ky/krs-292.325"},"notice":"GroundRules: Original legal text.
