{"data":{"id":"us-ky/krs-292.331","jurisdiction":"us-ky","citation":"KRS 292.331","heading":"Application for registration -- Contents -- Conditions -- Requirements.","body":"(1) A person shall apply for registration as a broker -dealer, agent, investment adviser,\nor investment adviser representative by filing an application containing the\ninformation required in a form designated by administrative regulation or order\nunder this ch apter, by filing a consent to service of process pursuant to KRS\n292.430, by filing any other information requested by the commissioner necessary\nto complete the application, and by paying the fee prescribed by this chapter.\n(2) If no denial order is in effect and no administrative proceeding is pending under this\nchapter, then registration becomes effective at 12 noon of the thirtieth day after a\ncompleted application is filed unless the commissioner specifies by order an earlier\nor later effective date. A registration shall be effective until December 31 of the year\nof registration, except that a registration as an agent of an issuer shall be effective\nfor the shorter of the term of the offering or a period of twelve (12) months.\n(3) An administrative regulation or order under this chapter may require as a condition\nof registration that the applicant and, in the case of a corporation or other legal\nentity, the officers or directors or persons occupying similar status or performing\nsimilar functions, pass a written examination as evidence of knowledge of the\nsecurities business.\n(4) Subject to the limitations of Section 15 of the Securities Exchange Act of 1934, 15\nU.S.C sec. 78o, and Section 222 of the Investment Advisers Act of 1940, 15 U.S.C.\nsec. 80b-18a, an administrative regulation or order under this chapter may establish\nminimum financial requirements for broker -dealers and investment advisers\nregistered or required to be registered under this chapter.\n(5) Registration of a broker -dealer, agent, invest ment adviser, or investment adviser\nrepresentative may be renewed by filing an application containing any information\nrequired by administrative regulation or order under this chapter and paying the fee\nprescribed in this chapter and, in the case of a brok er-dealer or investment adviser,\nfiling any financial statement required by administrative regulation or order under\nthis chapter.\n(6) An administrative regulation or order under this chapter may impose other\nconditions on registration or waive, in whole o r part, specific requirements in\nconnection with registration if appropriate in the public interest and consistent with\nthe protection of investors.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15541","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"5c5d57ed815cc6663fdf4e4a75b349a4f65ef16005122b8097a8ca1c28f3114c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.3301","next":"us-ky/krs-292.332"},"notice":"GroundRules: Original legal text.
