{"data":{"id":"us-ky/krs-292.332","jurisdiction":"us-ky","citation":"KRS 292.332","heading":"Notice filing by covered adviser -- Contents -- Exemptions -- Renewal.","body":"(1) It is unlawful for a covered adviser to transact business in this state as a covered\nadviser unless the covered adviser has made a notice filing under subsection (2) of\nthis section or is exempt from the requirement to make a notice filing under\nsubsection (3) of this section.\n(2) A person transacting business as a covered adviser in this state, who is not exempt\nunder subsection (3) of this section, shall make a notice filing consisting of a copy\nof those documents filed by the covered adviser with the Uni ted States Securities\nand Exchange Commission and pay the fee prescribed by this chapter. A notice\nfiling under this chapter is effective until 12 midnight of December 31 of the year\nfor which the notice is filed.\n(3) The following covered advisers are not  required to comply with subsection (2) of\nthis section:\n(a) A covered adviser who has no place of business in this state if his or her only\nclients in this state are investment advisers, covered advisers, broker -dealers,\nbanks, savings institutions, trust  companies, insurance companies, pension or\nprofit-sharing trusts, or other financial institutions or institutional buyers,\nwhether acting for themselves or as trustees;\n(b) A covered adviser who has no place of business in this state if, during any\nperiod of twelve (12) consecutive months, he or she does not have more than\nfive (5) clients other than those specified in paragraph (a) of this subsection;\nand\n(c) Any other covered adviser exempted from making a notice filing by\nadministrative regulation or order under this chapter.\n(4) A notice filing by a covered adviser may be renewed by filing a notice consisting of\nany documents filed with the United States Securities and Exchange Commission\nand paying the fee prescribed in this chapter.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15542","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"91916f76bcd536cc982ba440d836e1c5f3821bb2a97ae41fae319390fb5ff9bb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.331","next":"us-ky/krs-292.333"},"notice":"GroundRules: Original legal text.
