{"data":{"id":"us-ky/krs-292.460","jurisdiction":"us-ky","citation":"KRS 292.460","heading":"Investigations and subpoenas.","body":"(1) The commissioner in his or her discretion:\n(a) May make such public or private investigations within or outside of this state\nas he deems necessary to determine whether any registration should be\ngranted, denied, or revoked, or whether any person has viola ted or is about to\nviolate any provision of this chapter or any rule or order under this chapter, or\nto aid in the enforcement of this chapter or in the prescribing of rules and\nforms hereunder;\n(b) May require or permit any person to file a statement in w riting, under oath or\notherwise as the commissioner may determine, as to all the facts and\ncircumstances concerning the matter to be investigated; or\n(c) May publish information concerning any violation of this chapter or any rule\nor order hereunder.\n(2) For the purpose of any investigation or proceeding under this chapter, the\ncommissioner or any officer designated by him may administer oaths and\naffirmations, subpoena witnesses, compel their attendance, take evidence, and\nrequire production of any books, papers, correspondence, memoranda, agreements,\nor other documents or records which the commissioner deems relevant or material\nto the inquiry.\n(3) In case of contumacy by, or refusal to obey a subpoena issued to, any person, any\ncourt of competent jurisdiction, upon application by the commissioner, may issue to\nthat person an order requiring him to appear before the commissioner, or the officer\ndesignated by him, there to produce documentary evidence if so ordered or to give\nevidence touching the matter und er investigation or in question; and any failure to\nobey the order of the court may be punished by the court as a contempt of court.\n(4) No person is excused from attending and testifying or from producing any\ndocument or record before the commissioner, or in obedience to the subpoena of the\ncommissioner or any officer designated by him, or in any proceeding instituted by\nthe commissioner, on the ground that the testimony or evidence (documentary or\notherwise) required of the person may tend to incriminate the person or subject the\nperson to a penalty or forfeiture; but no individual may be prosecuted or subjected\nto any penalty or forfeiture for or on account of any transaction, matter, or thing\nconcerning which he is compelled, after claiming the privilege  against self -\nincrimination, to testify or produce evidence (documentary or otherwise), except\nthat the individual so testifying shall not be exempt from prosecution and\npunishment for perjury committed in so testifying.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15561","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"d8fa4b7998426fba5949704088fd71d7065c7579868be298ed578fb02595eed4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.450","next":"us-ky/krs-292.470"},"notice":"GroundRules: Original legal text.
