{"data":{"id":"us-ky/krs-292.470","jurisdiction":"us-ky","citation":"KRS 292.470","heading":"Remedies.","body":"Whenever it appears to the commissioner that any person has engaged or is about to\nengage in any act or practice constituting a violation of any provision of this chapter or\nany rule or order under this chapter, the commissioner may in his or her discretio n bring\nany or all of the following remedies:\n(1) Issue a cease and desist order, with or without a prior hearing, appealable to\nFranklin Circuit Court, against the person or persons engaged in the prohibited\nactivities directing that person or persons to cease and desist from illegal activity. In\norder to issue an order without a prior hearing, the commissioner must find that the\ndelay in issuing a final cease and desist order will cause harm to the public;\n(2) An action in the Franklin Circuit Court or an y other court of competent jurisdiction\nto enjoin any such acts or practices and to enforce compliance with this chapter or\nany rule or order under this chapter. Upon a proper showing a permanent or\ntemporary injunction, restraining order, or writ of manda mus shall be granted and a\nreceiver or conservator may be appointed for the defendant or the defendant's assets.\nUpon a proper showing by the commissioner, the court may enter an order of\nrescission, restitution, or disgorgement directed to any person who has engaged in\nany act constituting a violation of this chapter or any rule or order under this\nchapter. The commissioner may not be required to post a bond; or\n(3) Issue a final order, after notice and an opportunity for a hearing, containing findings\nof fact and conclusions of law, directing any person or persons found to have\nengaged in, or about to be engaged in, activity that constitutes a violation of this\nchapter or any rule or order under this chapter:\n(a) To cease and desist from the activity;\n(b) To perform any other reasonable mandates directed by the commissioner\npursuant to an appropriate remedy fashioned by the commissioner and\nreasonably calculated to carry out the provisions of this chapter; or\n(c) To pay fines assessed under KRS 292.500(14) and costs assessed under KRS\n292.500(15).","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15562","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"629e8966e411e8954e3d9cebe814b15233f59779486fef8e71a68bf4d33cd74b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.460","next":"us-ky/krs-292.480"},"notice":"GroundRules: Original legal text.
