{"data":{"id":"us-ky/krs-292.6510","jurisdiction":"us-ky","citation":"KRS 292.6510","heading":"Terms, conditions, and forms for registration.","body":"(1) A registering entity offering to accept registrations in beneficiary form may\nestablish the terms and conditions under which it will receive requests for\nregistrations in beneficiary form, and for implementation of registrations in\nbeneficiary form, includ ing requests for cancellation of previously -registered TOD\nbeneficiary designations and requests for reregistration to effect a change of\nbeneficiary. The terms and conditions so established may provide for proving death,\navoiding or resolving any problems  concerning fractional shares, designating\nprimary and contingent beneficiaries, and substituting a named beneficiary's\ndescendants to take in the place of a named beneficiary in the event of the\nbeneficiary's death. Substitution may be indicated by append ing to the name of the\nprimary beneficiary the letters LDPS, standing for \"lineal descendants per stirpes.\"\nThis designation substitutes a deceased beneficiary's descendants who survive the\nowner for a beneficiary who fails to so survive, the descendants t o be identified and\nto share in accordance with the law of the beneficiary's domicile at the owner's\ndeath governing inheritance by descendants of an intestate. Other forms of\nidentifying beneficiaries who are to take on one (1) or more contingencies, and rules\nfor providing proofs and assurances needed to satisfy reasonable concerns by\nregistering entities regarding conditions and identities relevant to accurate\nimplementation of registrations in beneficiary form, may be contained in a\nregistering entity's terms and conditions.\n(2) The following are illustrations of registrations in beneficiary form which a\nregistering entity may authorize:\n(a) Sole owner-sole beneficiary: John S Brown TOD (or POD) John S Brown Jr.;\n(b) Multiple owners-sole beneficiary: John S Brown Mary B Brown JT TEN TOD\nJohn S Brown Jr.; and\n(c) Multiple owners -primary and secondary (substituted) beneficiaries: John S\nBrown Mary B Brown JT TEN TOD John S Brown Jr SUB BENE Peter Q\nBrown; or John S Brown Mary B Brown JT TEN TOD John S Brown  Jr\nLDPS.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=15589","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"3f6681e19411c14a0e4564ad5da8f8df797419fbf856b9258057eab546a50981","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.6509","next":"us-ky/krs-292.6511"},"notice":"GroundRules: Original legal text.
