{"data":{"id":"us-ky/krs-292.991","jurisdiction":"us-ky","citation":"KRS 292.991","heading":"Penalties.","body":"(1) Any  person who  willfully violates any provision of KRS  292.330, 292.332,\n292.340, 292.450, or 292.500, or who willfully violates KRS  292.440 knowing\nthe statement made to be false or misleading in any material respect, shall be\nguilty of a Class D felony.\n(2) Any person who willfully violates any provision of KRS  292.320 shall be guilty\nof:\n(a) If the value of the fraud is equal to or exceeds one million dollars\n($1,000,000), a Class B felony;\n(b) If the value of the fraud is equal to or exceeds ten thousand dollars\n($10,000) but is less than one million dollars ($1,000,000), a Class C\nfelony; or\n(c) If the value of the fraud is less than ten thousand dollars ($10,000), a\nClass D felony.\n(3) Any  person who  willfully violates any rule or order of the commissioner,\nauthorized under this chapter, shall be guilty of a Class A misdemeanor; but no\nperson may  be imprisoned for violation of any rule or order of which that\nperson did not have actual knowledge.\n(4) The  commissioner may refer such evidence as may be available concerning\nviolations of this chapter or of any rule or order hereunder to the Attorney\nGeneral or the proper prosecuting authority, who may in his or her discretion,\nwith or without such a reference, institute the appropriate criminal proceedings\nunder this chapter.\n(5) Nothing in this chapter limits the power of the state to punish any person for\nany conduct which constitutes a crime by statute or at common  law.","path":["KRS Chapter 292"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45826","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:23Z","sha256":"455c817caeb98ab46cd3e507f0d47e27f0f9ecaa9b20ee64f6f6cfd5775548ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-292.990","next":"us-ky/krs-293.010"},"notice":"GroundRules: Original legal text.
