{"data":{"id":"us-ky/krs-29a.320","jurisdiction":"us-ky","citation":"KRS 29A.320","heading":"Duty of jury and officer after submission -- Causes for discharge of jury --","body":"Procedure for rendering verdict.\n(1) When the case is finally submitted to the jury, they shall retire for deliberation.\nWhen they retire, they shall be kept together in som e convenient place, under the\ncharge of an officer, until they agree upon a verdict or are discharged by the court,\nsubject to the Supreme Court rules permitting them to separate temporarily at night\nand for their meals.  The officer having them under his charge shall not allow any\ncommunications to be made to them, nor make any himself, except to ask them if\nthey have agreed upon their verdict, unless by order of the court; and he shall not,\nbefore their verdict is rendered, communicate to any person the s tate of their\ndeliberations, or the verdict agreed upon.\n(2) (a) The jury may be discharged by the court on account of the sickness of a juror,\nor other accident, calamity or circumstance requiring their discharge; or, by\nconsent of both parties; or, afte r they have been kept together until it\nsatisfactorily appears that there is no probability of their agreeing.\n(b) Cases in which the jury are discharged without making a verdict shall be tried\nagain at such time as the court may direct.\n(3) The procedure for rendering the verdict shall be:\n(a) When the jury have agreed on their verdict, the verdict shall be written and\nsigned by the foreman.\n(b) When a verdict is rendered by less than the whole jury, it shall be signed by all\nthe jurors who agree to it.\n(c) The foreman shall hand the verdict to the judge who shall read the verdict and\nthen make inquiry of the jury as to whether it is their verdict.\n(d) When the verdict is announced either party may require that the jury be polled,\nwhich is done by the judge asking each juror if it is his verdict.\n(e) If more than the number of jurors required by KRS 29A.280, as appropriate to\nthe type of case being tried, answers in the negative, the jury must be sent out\nfor further deliberation.\n(f) If no disagreem ent is expressed or, in an appropriate case, an insufficient\nnumber disagree, the verdict is complete and the jury shall be discharged from\nthe case.","path":["KRS Chapter 29A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21149","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:50Z","sha256":"ed5810bec8bd7fb3cbbb5ea94ddb2a5ff7d51c5c8295047e594d4739996e6021","source_id":"us-ky","stale":false,"prev":"us-ky/krs-29a.310","next":"us-ky/krs-29a.330"},"notice":"GroundRules: Original legal text.
