{"data":{"id":"us-ky/krs-304.1-200","jurisdiction":"us-ky","citation":"KRS 304.1-200","heading":"Definitions for section -- Applicability of cost -sharing requirements to","body":"health savings account-qualified insurance plans.\n(1) As used in this section:\n(a) \"Cost-sharing requirement\" means a:\n1. Prohibition outright on the imposition of any  deductible, copayment,\ncoinsurance, or other out-of-pocket expense, other than premiums, under\na health insurance policy, certificate, plan, or contract; or\n2. Limitation on the amount of any deductible, copayment, coinsurance, or\nother out-of-pocket expense, other than premiums, that is imposed under\na health insurance policy, certificate, plan, or contract;\n(b) \"Enrollee\":\n1. Means an individual who is enrolled in health insurance, whether on an\nindividual or a group basis; and\n2. Includes any covered de pendent of an individual referenced in\nsubparagraph 1. of this paragraph; and\n(c) \"Health savings account -qualified insurance plan\" means a high deductible\nhealth plan that covers individuals who may be entitled to receive certain tax\nbenefits under 26 U.S .C. sec. 223, as amended, with respect to contributions\nmade to a health savings account.\n(2) If, under federal law, the application of any cost -sharing requirement in this chapter\nor any other state law would cause an enrollee's health savings account -qualified\ninsurance plan to no longer qualify as a high deductible health plan under 26 U.S.C.\nsec. 223, as amended, then the cost -sharing requirement shall only apply to the\nenrollee's plan once the minimum deductible under 26 U.S.C. sec. 223, as amended,\nhas been satisfied.\n(3) In the event of a conflict between this section and any other state law,  this section\nshall control.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57263","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:36Z","sha256":"0f19faa7f84ba51b63e863be318d0e2ebed91c88e988d140ccc0522a7e8ab59d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.1-190","next":"us-ky/krs-304.10-010"},"notice":"GroundRules: Original legal text.
