{"data":{"id":"us-ky/krs-304.12-080","jurisdiction":"us-ky","citation":"KRS 304.12-080","heading":"Unfair discrimination prohibited.","body":"(1) No insurer, other than a life insurer or health insurer, shall make or permit any\nunfair discrimination in favor of particular persons, or between insureds or subjects\nof insurance having substantially like insuring risk, and exposure factors, or expense\nelements, in the terms or conditions of any insurance contract, or in the rate or\namount of premium charged therefor. This subsection shall not apply as to any\npremium or premium rate in effect pursuant to Subtitle 13.\n(2) No insurer shall make or permit an y unfair discrimination between individuals of\nthe same class and equal expectation of life in the rates charged for any contract of\nlife insurance or of life annuity or in the dividends or other benefits payable thereon,\nor in any other of the terms and c onditions of such contract, except that in\ndetermining the class, consideration may be given to the nature of the risk, plan of\ninsurance, the actual or expected expense of conducting the business or any other\nrelevant factor.\n(3) No insurer shall make or permit any unfair discrimination between individuals of\nthe same class involving essentially the same hazards in the amount of premium,\npolicy fees, or rates charged for any policy or contract of health insurance or in the\nbenefits payable thereunder, or in any of the terms or conditions of such contract, or\nin any other manner whatsoever, except that in determining the class, consideration\nmay be given to the nature of the risk, plan of insurance, the actual or expected\nexpense of conducting the business or any other relevant factor.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17018","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:41Z","sha256":"832612c272b3cb7780a5685187bafe0b8c704b8e6c2317a969dbcc33afc07e7d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.12-070","next":"us-ky/krs-304.12-085"},"notice":"GroundRules: Original legal text.
