{"data":{"id":"us-ky/krs-304.12-100","jurisdiction":"us-ky","citation":"KRS 304.12-100","heading":"Exceptions to discrimination and rebate prohibition.","body":"Nothing in KRS 304.12 -080, 304.12 -090, or 304.12 -110 shall be construed as\nprohibiting:\n(1) Payment of lawfully earned commission or other lawful compensation to duly\nlicensed insurance producers, as defined in KRS 304.9 -020, or compensation\ndisclosed in a written disclosure agreement, as described in KRS 304.11-042;\n(2) Distribution by a participating insurer to its participating policyholders of dividends,\nsavings, or the unused or unabsorbed portion of premiums and premium deposits;\n(3) (a) Furnishing of  information, advice, programs, products, or services that are\nintended to:\n1. Reduce the future cost of insurance to the policyholder or the probability\nor severity of loss;\n2. Assist in the efficient administration and management of the\npolicyholder's insurance program; or\n3. Assist the client in complying with any state or federal law.\n(b) Such information, advice, programs, products, or services shall include but are\nnot limited to providing software to administer an insured's employee benefits\nor risk management programs, employee wellness programs, risk management\nservices, loss control services, and workers' compensation analysis\nforecasting;\n(4) Life insurers from paying bonuses to policyholders or otherwise abating their\npremiums in whole or in part  out of surplus accumulated from nonparticipating\ninsurance, if such bonus or abatement is fair and equitable to all policyholders and\nfor the best interests of the insurer and its policyholders;\n(5) In the case of insurance policies issued on the debit pl an, making allowance to\npolicyholders who have continuously for a specified period made premium\npayments directly to an office of the insurer in an amount which fairly represents\nthe savings in collection expense or making allowance to policyholders who ma ke\npremium payments at less frequent intervals than required;\n(6) Readjustment of the rate of premium for a group insurance policy based on the loss\nor expense experience thereunder, at the end of any policy year of insurance\nthereunder, which may be made retroactive only for such policy year;\n(7) An insurer from waiving , in whole or in part, a policyholder's deductible for food\nspoilage for an insured risk located in a county declared to be a federal disaster area;\n(8) Payment of any compensation, fee, or other consideration to an individual not\nlicensed to sell insuranc e if such individual sells, solicits, or negotiates rental\nvehicle insurance in accordance with KRS 304.9 -507 or for the referral of a\nconsumer to a licensed individual in accordance with KRS 304.9-425;\n(9) Any conduct permitted under KRS 304.12-092; or\n(10) Charitable contributions by an insurer or insurance producer, as defined in KRS\n304.9-020, unless the contributions are made in connection with the purchase or\nrenewal of insurance.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52655","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:41Z","sha256":"ac61b871b281fd948867474263f806570d44f5c49ed920bf6f0bf5ca0b6a7398","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.12-092","next":"us-ky/krs-304.12-110"},"notice":"GroundRules: Original legal text.
