{"data":{"id":"us-ky/krs-304.12-130","jurisdiction":"us-ky","citation":"KRS 304.12-130","heading":"Curtailment of undefined practices.","body":"(1) If the commissioner believes that any person engaged in the insurance business is\nengaging in this state in any method of competition or in any act or practice in the\nconduct of such business which is not defined in this subtitle but that such method\nof competition is unfair, deceptive, or not in the public interest, or that such act or\npractice is unfair or deceptive and that a proceeding by the commissioner in respect\nthereto would be in the public interest, the commissioner shall, after a hearing of\nwhich notice of the hearing and of the charges against the person are given such\nperson, make a written report of his or her findings of fact relative to such charges\nand serve a copy thereof upon such person and any intervenor at the hearing.\n(2) If such report charges a violation of this subtitle and if such method of competition,\nact or practice has not been discontinued, the commissioner may, or through the\nAttorney General, at any time after the service of such report, cause an action to be\ninstituted to e njoin and restrain such person from engaging in such method, act, or\npractice. In such action the court may grant a restraining order or injunction upon\nsuch terms as may be just; but the people of this Commonwealth shall not be\nrequired to give security b efore the issuance of any such order or injunction. If a\nstenographic record of the proceedings in the hearing before the commissioner was\nmade, a certified transcript thereof including all evidence taken and the report and\nfindings shall be received in evidence in such action.\n(3) If the commissioner's report made pursuant to subsection (1) of this section or order\non hearing made pursuant to KRS 304.12 -120 does not charge a violation of this\nsubtitle, then any intervenor in the proceedings may appeal ther efrom within the\ntime and in the manner provided in this code for appeals from the commissioner\ngenerally.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17025","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:41Z","sha256":"a183936cbec8f92f30e992972886d748ab097cfe179c58178d5b48226d719085","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.12-120","next":"us-ky/krs-304.12-140"},"notice":"GroundRules: Original legal text.
