{"data":{"id":"us-ky/krs-304.13-053","jurisdiction":"us-ky","citation":"KRS 304.13-053","heading":"Filing procedures for rates for use after December 31, 1998.","body":"(1) Unless the commissioner enters an order pursuant to KRS 304.13 -041 declaring\nworkers' compensation to be a noncompetitive market, rates filed for use after\nDecember 31, 1998, shall be filed pursuant to KRS 304.13-051(1).\n(2) Notwithstanding the provisions of KRS 304.13-051 to the contrary, after December\n31, 1998, no insurer providing workers' compensation insurance shall place into\neffect any rates, manuals, or underwriting rules for workers' compensation insurance\nwhich it proposes to use pursuant to KRS 304.13-051(1) or (4) if the rates, manuals,\nor underwriting rules will result in an increase or decrease of more than fifteen\npercent (15%) from the workers' compensation insurer's then -existing workers'\ncompensation insurance rates for any classification of risks within a twelve (12)\nmonth period of time.\n(3) After December 31, 1998, any workers' compensation insurer which proposes to\nchange its then -existing rates, manuals, or underwriting rules so as to effectively\nincrease or decrease the rates of any classification of risks more than fifteen percent\n(15%) within a twelve (12) month period shall file all the rates and supplemental\nrating information which shall not become effective until approved by the\ncommissioner pursuant to the provisions of KRS 304.13-051.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17056","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"4692051910348d5ee41b4b9847bebc209010f0e13bd502bcc0708e60bcadcda0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-051","next":"us-ky/krs-304.13-055"},"notice":"GroundRules: Original legal text.
