{"data":{"id":"us-ky/krs-304.13-061","jurisdiction":"us-ky","citation":"KRS 304.13-061","heading":"Information that may support rate filing -- Administrative regulations","body":"on recording and reporting rates and other information.\n(1) The information furnished in support of a filing may include:\n(a) The experience or judgment of the insurer;\n(b) The insurer's interpretation of any statistical data it relies on;\n(c) The experience of other insurers; and\n(d) Any other relevant factors.\n(2) The commissioner may adopt reasonable administrative regulations for use by\ninsurers to record and report to the co mmissioner their rates and other information\ndetermined by the commissioner to be necessary or appropriate for the\nadministration of KRS 304.13 -011 to 304.13 -161, and the effectuation of its\npurposes. The commissioner may adopt reasonable administrative re gulations to\nassure that the experience of all insurers is made available at least annually in such\nform and detail as is necessary to aid in determining whether rating systems comply\nwith the standards set forth in this subtitle. The commissioner may designate one (1)\nor more advisory organizations or statistical agents to assist him or her in gathering,\ncompiling, and reporting such information, which shall be a matter of public record.\nThe scope of these rules may include the data which must be reported by insurers,\ndefinitions of data elements, the timing and frequency of statistical reporting by\ninsurers, data quality standards, data edit and audit requirements, data retention\nrequirements, reports to be generated by advisory organizations or statistica l agents\nto fulfill the requirements of this section, and the timing of such reports.\n(3) The commissioner may promulgate administrative regulations for the interchange of\ndata necessary for the application of rating plans.\n(4) In order to further uniform administration of rate regulatory laws, the commissioner\nand every insurer, advisory organization, and statistical agent may exchange\ninformation and experience data with insurance supervisory officials, insurers, and\nadvisory organizations in other states and may consult with them with respect to the\napplication of rating systems and the collection of statistical data.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17061","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"4d0061f262ea56731dedc8e02fbcbaedf386dfc5b696b59b0eba95b0c635ac77","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-060","next":"us-ky/krs-304.13-063"},"notice":"GroundRules: Original legal text.
