{"data":{"id":"us-ky/krs-304.13-071","jurisdiction":"us-ky","citation":"KRS 304.13-071","heading":"Disapproval of rates and rate filings.","body":"(1) Existing rates in a noncompetitive market may be disapproved pursuant to the rating\nstandards of this chapter after a hearing. Rates that have been filed in a\nnoncompetitive market but that have not become effective may be disapproved\npursuant to the ratin g standards of this chapter without a hearing. However, any\ninsurer whose rates have been disapproved without a hearing shall be given a\nhearing on a written request made within thirty (30) days after the disapproval\norder. Hearings conducted under authori ty of this section shall be conducted in\naccordance with KRS Chapter 13B. If a rate is disapproved, the commissioner shall\nissue a final order specifying the reasons for disapproval. Any party aggrieved by\nthe final order of the commissioner may appeal as provided in KRS 304.2-370. The\neffect of a final order shall be stayed during the pendency of the appeal and the\nexisting rate shall remain in effect until the final conclusion thereof.\n(2) At any hearing concerning an increase in worker's compensation rat es conducted\npursuant to subsection (1), the commissioner may approve a rate other than one that\nhas been proposed by the filer if it is justified by the evidence presented at the\nhearing.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17065","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"ee16ac955f2c31f59522aa7abdce590573e7fa292d8d1e1b4a9ce0bb07187ff5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-070","next":"us-ky/krs-304.13-075"},"notice":"GroundRules: Original legal text.
