{"data":{"id":"us-ky/krs-304.13-091","jurisdiction":"us-ky","citation":"KRS 304.13-091","heading":"License for advisory organization, statistical agent, or form provider --","body":"Refusal to supply services -- Application for license -- Fees.\n(1) No advisory organization, statistical agent, or form provider shall provide any\notherwise permitted service , and no insurer shall utilize the services unless the\norganization has obtained a license pursuant to subsection (3) of this section.\n(2) No advisory organization, statistical agent, or form provider shall refuse to supply\nany services for which it is lic ensed in Kentucky to any insurer authorized to do\nbusiness in Kentucky and offering to pay the fair and usual compensation for the\nservices.\n(3) An advisory organization, statistical agent, or form provider applying for a license\nshall include with its application:\n(a) A copy of its constitution, charter, articles of organization, agreement,\nassociation or incorporation, bylaws, plan of operation, and any other rules or\nregulations governing the conduct of its business;\n(b) A list of its members, subscribers, and customers;\n(c) The name and address of one (1) or more residents of Kentucky upon whom\nnotices, process affecting it, or orders of the commissioner may be served;\n(d) A statement showing its technical qualifications for acting in the capacity for\nwhich it seeks a license;\n(e) A biography of the ownership and management of the organization; and\n(f) Any other relevant information and documents that the commissioner may\nrequire.\n(4) Every organization which has applied for a license shall notify the com missioner of\nevery material change in the facts or in the documents on which its application was\nbased. Any amendment to a document filed under this section shall be filed at least\nthirty (30) days before it becomes effective.\n(5) If the commissioner finds  that the applicant and the natural persons through whom\nit acts are competent, trustworthy, and technically qualified to provide the services\nproposed, and that all requirements of the law are met, he or she shall issue a license\nspecifying the authorized activity of the applicant. The commissioner shall not issue\na license if the proposed activity would tend to create a monopoly or to substantially\nlessen the competition in any market. At the request of the licensee, licenses issued\nunder this section may be renewed on an annual basis.\n(6) Licenses issued pursuant to this section shall remain in effect for one (1) year\nunless:\n(a) The licensee fails to pay fees required by law for the continuance or renewal\nof its license;\n(b) The licensee withdraws from the state; or\n(c) The license is suspended or revoked.\nThe commissioner may at any time, after a hearing to be conducted in accordance\nwith the provisions of this chapter and KRS 304.2 -310, revoke or suspend the\nlicense of an advisory organization, statistical agent, or form provider which does\nnot comply with the requirements and standards of this chapter.\n(7) The commissioner shall by administrative regulation establish a written summary of\ninformation that shall be included in an application for licenses issued under this\nsection.\n(8) Advisory organizations wishing to operate as statistical agents or form providers\nmay be so authorized under their license as an advisory organization. A separate\nlicense is not required.\n(9) Each advisory organization, statistical agent, and form provider shall pay fees as\nrequired by KRS 304.4 -010 for the application, continuance, or renewal of its\nlicense.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17069","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"0450ec2dd7e30773928fb474ef97940d651345fc9596223f587c323c8fb03c76","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-090","next":"us-ky/krs-304.13-100"},"notice":"GroundRules: Original legal text.
