{"data":{"id":"us-ky/krs-304.13-131","jurisdiction":"us-ky","citation":"KRS 304.13-131","heading":"Insurer and advisory organization activities prohibited.","body":"(1) No insurer or advisory organization shall make any arrangement with any other\ninsurer, advisory organization, or other person that has the purpose or effect of\nunreasonably restraining trade or unreasonably lessening competition in the\nbusiness of insurance.\n(2) No insurer or advisory organization shall:\n(a) Attempt to monopolize, or combine, or conspire with any other person to\nmonopolize an insurance market; or\n(b) Engage in a boycott, on a concerted basis, of an insurance market.\n(3) No insurer shall agr ee with any other insurer or with an advisory organization to\nmandate adherence to, or to mandate use of, any rate, prospective loss cost, rating\nplan, rating schedule, rating rule, policy or bond form, rate classification, rate\nterritory, underwriting rule, survey, inspection or similar material, except as needed\nto facilitate the reporting of statistics to advisory organizations, statistical agents, or\nthe commissioner. The fact that two (2) or more insurers, whether or not members\nor subscribers of an ad visory organization, use consistently or intermittently the\nsame rates, prospective loss cost, rating plans, rating schedules, rating rules, policy\nor bond forms, rate classifications, rate territories, underwriting rules, surveys, or\ninspections or similar materials is not sufficient in itself to support a finding that an\nagreement exists.\n(4) Two (2) or more insurers having a common ownership or operating in this state\nunder common management or control may act in concert between or among\nthemselves with respect to any matters pertaining to those activities authorized in\nthis chapter as if they constituted a single insurer.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17076","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"9573745f0a70da69c52a4295dd68066c45a3401759ee7d19975ecd42875eadff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-130","next":"us-ky/krs-304.13-140"},"notice":"GroundRules: Original legal text.
