{"data":{"id":"us-ky/krs-304.13-161","jurisdiction":"us-ky","citation":"KRS 304.13-161","heading":"Review of application of rating system to an insured -- Appeal to","body":"commissioner -- Notification of review rights to workers' compensation\ninsureds.\n(1) Every insurer or advisory organization shall provide within this state reasonable\nmeans whereby any person aggrieved by the application of its rating system may be\nheard on written request to review the manner in which the rating system has been\napplied. If the insurer or advisory organization grants the request, the review shall\nbe conducted within n inety (90) days of receiving the request. If the insurer or\nadvisory organization fails to grant or rejects a request within thirty (30) days, the\naggrieved person may proceed in the same manner as if the review produced no\nchange in the application of the rate.\n(2) Any party affected by the action made on the request for review may within thirty\n(30) days of written notice of action appeal to the commissioner for further review\nof the application of the rating system. The commissioner shall hold a hearing in\naccordance with KRS Chapter 13B on a showing of good cause. The commissioner\nmay after the hearing issue a final order affirming, modifying, or reversing the\naction of the insurer or advisory organization.\n(3) For workers' compensation coverage, each in surer or agent shall notify in writing\neach insured at the time a workers' compensation insurance policy is issued or\nrenewed on or after May 1, 1997, of the insured's rights afforded by this section.\nThe written notice required in this subsection shall ap ply only to workers'\ncompensation insurers and shall be provided in the manner and format prescribed\nthrough administrative regulations promulgated by the commissioner.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17082","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:42Z","sha256":"9612bc634e302f3426ffc2d134727571654305ff516beb89a3e0a6dcc170a550","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-160","next":"us-ky/krs-304.13-163"},"notice":"GroundRules: Original legal text.
