{"data":{"id":"us-ky/krs-304.13-415","jurisdiction":"us-ky","citation":"KRS 304.13-415","heading":"Experience modification factor for workers' compensation -- Written","body":"explanation to workers' compensation policyholders -- Authority for\nadministrative regulations.\n(1) Every employer that is assigned an experience modification factor for workers'\ncompensation in order to determine its workers' compensation premium shall be\nfurnished without charge a complete copy of the data and calculations of the\nexperience modification by the insurance company or any entity to which the\ninsurance company may dele gate the duty of calculating and promulgating the\nexperience modification or, if applicable, by any self -insurance group of which the\nemployer is a member.\n(2) Experience modification shall be based upon all payrolls and claims experience for\nthe applicabl e period regardless of whether the employer was insured by an\ninsurance company, was a member of a self -insurance group, or was a member of\nthe Kentucky Workers' Compensation Assigned Risk Plan for part or all of the\nperiod.\n(3) For each workers' compensation insurance policy issued or renewed on or after May\n1, 1997, the workers' compensation insurer or the licensed advisory organization\nshall provide, in accordance with subsection (1) of this section, the policyholder\nwith a written explanation of the pol icyholder's experience modification factor and\nthe data and methodology utilized in the calculation of the factor.\n(4) The commissioner shall promulgate administrative regulations to establish the\nguidelines for application of the experience modification factors.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17117","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:43Z","sha256":"d85838630feaae251ccccc964c9a02d1a122a35d9f96b4d30341f5b01c2e1b2a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.13-412","next":"us-ky/krs-304.13-420"},"notice":"GroundRules: Original legal text.
