{"data":{"id":"us-ky/krs-304.14-435","jurisdiction":"us-ky","citation":"KRS 304.14-435","heading":"English language requirement for forms, policy, and claim -related","body":"information -- Requirements for non -English version -- Use and effect of\ntranslations.\n(1) All policy forms filed with the department, and any other insurance policy or claim-\nrelated information, shall be written in the English language.\n(2) An insurer may provide applicants and insureds with a policy, application, or claim-\nrelated information in a language other than English if the conditions of subsection\n(3) of this section have been satisfied.\n(3) The non -English version of the policy, application, or claim -related information\nshall:\n(a) Be a certified translation of a policy, application, or claim -related information\nthat has been filed with and approved by the department;\n(b) Be accompanied by a certification written in English that the non -English\nversion is a complete and accurate translation of the English form filed;\n(c) Be in the same format as the English version;\n(d) Contain a disclosure, both in the non -English language and in English, that is\nattached to the front of the policy, application, or claim -related information,\nincluding a statement indicating that:\n1. The policy, application, or claim-related information is a translation that\nhas not been approved by the department; and\n2. The English version of the policy, application, or claim -related\ninformation shall control in any disputes, complaints, or litigation; and\n(e) Identify the English form number that corresponds to the non-English version.\n(4) If an insurer offer s a non -English policy, application, or claim -related information\nin accordance with subsections (2) and (3) of this section, the insurer shall file the\ntranslator certification and disclosure required by paragraph (d) of subsection (3)\nwith the department as an information filing.\n(5) This section shall not prohibit an insurer from advertising or providing information\nrelated to the policy or claims with translations to consumers in a language other\nthan English.\n(6) If there is a dispute between the English version and the non -English version, the\nEnglish version shall control and the non-English version shall carry a disclaimer in\nthe non-English language to this effect. The insurance policy is controlling and any\nadvertisements or informational materials used by an insurer shall not be construed\nto modify or change the insurance policy.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17164","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:43Z","sha256":"83346087b49ef235efa8771c25945ca8a8f03cf16f656a2bcac64db6a2ac4bd1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.14-430","next":"us-ky/krs-304.14-440"},"notice":"GroundRules: Original legal text.
