{"data":{"id":"us-ky/krs-304.14-440","jurisdiction":"us-ky","citation":"KRS 304.14-440","heading":"Policies to be readable -- Factors to be considered.","body":"(1) All insurance policies subject to the provisions of KRS 304.14 -420 to 304.14 -450\nshall be written in language easily readable and understandable by a person of\naverage intelligence and education.\n(2) In determining whether a policy or contract is readable within the meaning of this\nsection the commissioner shall consider, at least, the following factors:\n(a) The simplicity of the sentence structure and the shortness of the sentences\nused;\n(b) The extent to which commonly used and understood words are employed;\n(c) The extent to which legal terms are avoided;\n(d) The extent to which references to other sections or provisions of the contract\nare minimized;\n(e) The extent to which definitional provisions are incorporated in the text of the\npolicy or contract; and\n(f) Any additional factors relevant to the readability or understandability of an\ninsurance policy or contract which the commissioner may prescribe by\nregulation.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17165","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:43Z","sha256":"22a341cb0b40371df2a13f5d7ae4c586e1ff5dbffee04e250c745f945f9cdde1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.14-435","next":"us-ky/krs-304.14-450"},"notice":"GroundRules: Original legal text.
