{"data":{"id":"us-ky/krs-304.14-510","jurisdiction":"us-ky","citation":"KRS 304.14-510","heading":"Minimum standards regulations.","body":"The commissioner may make reasonable rules and regulations establishing minimum\nstandards for Medicare supplement insurance policies delivered or issued for delivery in\nthe state. Such regulations may cover but are not limited to:\n(1) Establishing specific standards for policy provisions;\n(2) Prohibiting policy provisions which in the opinion of the commissioner are unjust,\nunfair, or unfairly discriminatory to any person insured or proposed for coverage\nunder a Medicare supplement policy;\n(3) Establishing minimum standards for benefits under Medicare supplement policies;\n(4) Prescribing the format and content of the outline of coverage required by KRS\n304.14-540. For purposes of this section, \"format\" means style, arrangements, and\noverall appearance, including such items as the size, color, and prominence of type\nand the arrangement of text and captions. Such outline of coverage shall include:\n(a) A description of the principal benefits and coverage provided in the policy;\n(b) A statement of the exceptions,  reductions, and limitations contained in the\npolicy;\n(c) A statement of the renewal provisions, including any reservation by the\ninsurer of a right to change premiums;\n(d) A statement that the outline of coverage is a summary of the policy issued or\napplied for and that the policy should be consulted to determine governing\ncontractual provisions.\n(5) Prescribing a standard form and the contents of an informational brochure for\npersons eligible for Medicare which is intended to improve the buyer's ability t o\nselect the most appropriate coverage and improve the buyer's understanding of\nMedicare. Except in the case of direct response insurance policies, the\ncommissioner may require by regulation that the information brochure be provided\nto any prospective insu reds eligible for Medicare concurrently with delivery of the\noutline of coverage. With respect to direct response insurance policies, the\ncommissioner may require by regulation that the prescribed brochure be provided\nupon request to any prospective insureds eligible for Medicare, but in no event later\nthan the time of policy delivery.\n(6) Establishing reasonable captions and notice requirements, determined to be in the\npublic interest and designed to inform prospective insureds that particular insurance\ncoverages are not Medicare supplement coverages, for all accident and sickness\ninsurance policies sold to persons eligible for Medicare, other than:\n(a) Medicare supplement policies; or\n(b) Disability income policies.\n(7) Governing the full and fair disclosure of the information in connection with the\nreplacement of accident and sickness policies, subscriber contracts, or certificates\nby persons eligible for Medicare.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17168","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:43Z","sha256":"ceab5f2c03ee01bf44a2ded9328357cd31fa99ceccc0b743e6dc4c79efd6ebfa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.14-500","next":"us-ky/krs-304.14-520"},"notice":"GroundRules: Original legal text.
