{"data":{"id":"us-ky/krs-304.14-642","jurisdiction":"us-ky","citation":"KRS 304.14-642","heading":"Kentucky Long -Term Care Partnership Insurance Program -- Policy","body":"component requirements -- Administrative regulations.\n(1) The Kentucky Long -Term Care Partnership Insurance Program is established as a\npartnership between the Department for Medicaid Services and the Department of\nInsurance to:\n(a) Provide incentives for an individual to insure against the cost of providing for\nhis or her long-term care needs;\n(b) Increase utilization of long-term care insurance policies;\n(c) Assist in alleviating the financial burden of Kentucky's Medicaid program by\nencouraging the use of private insurance; and\n(d) Provide a mechanism for individuals to qualify for Medicaid services for costs\nof long-term care without exhausting all of their assets and resources.\n(2) A long-term care partnership insurance policy shall:\n(a) Provide coverage for expenses for at least twelve (12) months for each\ncovered person on an expense -incurred, indemnity, or prepaid basis for one\n(1) or more long -term care services provided  in a setting other than an acute\ncare unit of a hospital;\n(b) Be qualified under Section 7702B(b) of the Internal Revenue Code of 1986;\n(c) Provide coverage for long -term care services for a policyholder who is a\nresident of a state with a qualified long -term care partnership program when\ncoverage first became effective; and\n(d) Not be issued prior to the effective date of an approved amendment to the\nState Medicaid Plan.\n(3) The Department of Insurance shall have responsibility to approve, pursuant to KRS\n304.14-120, any long-term care partnership insurance policy available in Kentucky\nthat meets and continues to meet all applicable federal and state laws and\nregulations. The state shall not impose any requirement affecting the terms or\nbenefits of such a policy unless the state imposes such requirement on long -term\ncare insurance policies without regard to whether the policy is covered under the\npartnership or is offered in connection with the partnership.\n(4) The Department of Insurance shall ensure that any agent who sells a long -term care\npartnership insurance policy can demonstrate an understanding of long -term care\npartnership insurance and how it relates to other public a nd private coverage of\nlong-term care expenses. The Department for Medicaid Services shall provide\nconsultation, materials, and other information to the Department of Insurance to\nenable the Department of Insurance to facilitate the development and issuanc e of\nuniform training materials for agents who sell long -term care insurance policies.\nThe Department of Insurance may contract with another entity to conduct agent\ntraining and testing. Training and certification may be conducted at the expense of\nthe insurance agent.\n(5) Within sixty (60) days of notice of approval of the amendment to the State\nMedicaid Plan required under KRS 205.619, the Department of Insurance shall\npromulgate an administrative regulation pursuant to KRS Chapter 13A to\nimplement the Kentucky Long-Term Care Partnership Insurance Program.\n(6) The Department of Insurance and the Department for Medicaid Services shall\nreport no later than September 30 each year to the Interim Joint Committee on\nBanking and Insurance and the Interim Joint Co mmittee on Health Services on the\nnumber of partnership insurance policies sold in Kentucky, utilization of the\npartnership insurance policies, and expenditures and cost savings associated with\nimplementation, utilization, and maintenance of the partnership program. If national\ndata reporting standards become available, the report submitted to the federal\nagency shall meet the requirements of this subsection.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53706","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:44Z","sha256":"ff1fa8e38ad3baa56805c08438a17700197395909662f925173a786e8a536b2b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.14-640","next":"us-ky/krs-304.14-644"},"notice":"GroundRules: Original legal text.
