{"data":{"id":"us-ky/krs-304.15-115","jurisdiction":"us-ky","citation":"KRS 304.15-115","heading":"Life insurance policy loan interest rates.","body":"(1) As used in this section:\n(a) \"Policy\" includes annuity contracts as defined in KRS 304.5 -030 which\nprovide for policy loans, and certificates issued by a fraternal benefit society\nas defined in KRS 304.29-011;\n(b) \"Policyholder\" includes the owner of the policy or the person desig nated to\npay premiums as shown on the records of the life insurer;\n(c) \"Policy loan\" includes an advance of cash as specified in KRS 304.15-110 and\nany premium loan made under a policy to pay one (1) or more premiums that\nwere not paid to the life insurer as they fell due; and\n(d) \"Published monthly average\" means Moody's Corporate Bond Yield Average -\nMonthly Average Corporates as published by Moody's Investors Service, Inc.\nor any successor thereto, or, in the event that Moody's Corporate Bond Yield\nAverage - Monthly Average Corporates is no longer published, a substantially\nsimilar average prescribed by the commissioner.\n(2) Notwithstanding any other provision of law:\n(a) Policies issued on or after July 13, 1984, shall contain either, but not both, of\nthe following policy loan interest rate provisions:\n1. A provision permitting a maximum interest rate of not more than eight\npercent (8%) per annum; or\n2. A provision permitting an adjustable maximum interest rate established\nat regular intervals by the life insurer as permitted by law;\n(b) The rate of interest charged on a policy loan made under paragraph (a)2. of\nthis subsection shall not exceed eighteen percent (18%) nor the higher of the\nfollowing:\n1. The published monthly average for the calendar month e nding two (2)\nmonths before the date on which the rate is determined; or\n2. The rate used to compute cash surrender values under the policy during\nthe applicable period plus one percent (1%) per annum;\n(c) If the maximum rate of interest is determined pursuant to paragraph (a)2. of\nthis subsection, the policy shall contain a provision setting forth the frequency\nat which the rate is to be determined for that policy;\n(d) The maximum rate for each policy shall  be determined at regular intervals at\nleast once every twelve (12) months, but not more frequently than once in any\nthree (3) month period. At the intervals specified in the policy:\n1. The rate being charged may be increased whenever such increase as\ndetermined under paragraph (b) of this subsection would increase the\nrate by one-half of one percent (0.5%) or more per annum;\n2. The rate being charged shall be reduced whenever such reduction as\ndetermined under paragraph (b) of this subsection would decreas e that\nrate by one-half of one percent (0.5%) or more per annum;\n(e) The life insurer shall:\n1. Notify the policyholder at the time an advance of cash is made of the\ninitial rate of interest on the loan;\n2. Notify the policyholder with respect to premium l oans of the initial rate\nof interest on the loan as soon as it is reasonably practical to do so after\nmaking the initial loan. Notice need not be given to the policyholder\nwhen a further premium loan is added, except as provided in\nsubparagraph 3. of this paragraph;\n3. Send to policyholders with loans reasonable advance notice of any\nincrease in the rate; and\n4. Include in the notices required in subparagraphs 1., 2., and 3. of this\nparagraph the substance of the pertinent provisions of paragraphs (a) and\n(c) of this subsection;\n(f) The loan value of the policy shall be determined in accordance with KRS\n304.15-110, but no policy shall terminate in a policy year as the sole result of\nchanges in the interest rate during that policy year. The life insurer shall\nmaintain coverage during that policy year until such time at which it would\notherwise have terminated if there had been no change during that policy year;\n(g) The substance of the pertinent provisions of paragraphs (a) and (c) of this\nsubsection shall be set forth in the policies to which they apply;\n(h) For the purposes of this section, the rate of interest on policy loans permitted\nunder this section shall include the interest rate charged for reinstatement of\npolicy loans for the period during and after any lapse of a policy; and\n(i) No other provision of law shall apply to policy loan interest rates unless such\nprovision specifically applies to such rates.\n(3) The provisions of this section shall not apply to any policy issued before July 13,\n1984, unle ss the policyholder agrees in writing to the applicability of such\nprovisions.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17208","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:44Z","sha256":"5843f10f0aa07f34c82d6b5a3622ab46f51983f10c0b504b8f5205873d961460","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.15-110","next":"us-ky/krs-304.15-120"},"notice":"GroundRules: Original legal text.
