{"data":{"id":"us-ky/krs-304.16-030","jurisdiction":"us-ky","citation":"KRS 304.16-030","heading":"Employee groups.","body":"The lives of a group of individuals may be insured under a policy issued to an employer,\nor to the trustees of a fund established by an employer, which employer or trustees shall\nbe deemed the policyholder, to insure employees of the employer for the benef it of\npersons other than the employer, subject to the following requirements:\n(1) The employees eligible for insurance under the policy shall be all of the employees\nof the employer, or all of any class or classes thereof determined by conditions\npertaining to their employment. The policy may provide that the term \"employees\"\nshall include the employees of one (1) or more subsidiary corporations, and the\nemployees, individual proprietors, and partners of one (1) or more affiliated\ncorporations, proprietors or partnerships if the business of the employer and of such\naffiliated corporations, proprietors or partnerships is under common control through\nstock ownership, contract or otherwise. The policy may provide that the term\n\"employees\" shall include the individual proprietor or partners if the employer is an\nindividual proprietor or a partnership. The policy may provide that the term\n\"employees\" shall include retired employees. No director of a corporate employer\nshall be eligible for insurance under the poli cy unless such person is otherwise\neligible as a bona fide employee of the corporation by performing services other\nthan the usual duties of a director. No individual proprietor or partner shall be\neligible for insurance under the policy unless he is actively engaged in and devotes a\nsubstantial part of his time to the conduct of the business of the proprietor or\npartnership. A policy issued to insure the employees of a public body may provide\nthat the term \"employees\" shall include elected or appointed officials;\n(2) The premium for the policy shall be paid by the policyholder, either wholly from the\nemployer's funds or funds contributed by him, partly from such funds and partly\nfrom funds contributed by the insured employees, or entirely from funds contributed\nby the insured employees. Except as provided in subsection (3) of this section, a\npolicy on which no part of the premium is to be derived from funds contributed by\nthe insured employees shall insure all eligible employees, except those who reject\nthe coverage in writing;\n(3) An insurer may exclude or limit the coverage on any person for whom evidence of\nindividual insurability is not satisfactory to the insurer; and\n(4) The amounts of insurance under the policy must be based upon some plan\nprecluding i ndividual selection either by the employees or by the employer or\ntrustees.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40546","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:44Z","sha256":"ee4adfd324da8b548ef2988596d29d016bb745d3ba8f27ecc76ccb996f1c8889","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.16-020","next":"us-ky/krs-304.16-035"},"notice":"GroundRules: Original legal text.
