{"data":{"id":"us-ky/krs-304.16-080","jurisdiction":"us-ky","citation":"KRS 304.16-080","heading":"Association groups.","body":"(1) A policy may be issued to an association of employers, to an association (other than\nan association of public employees to whom KRS 304.16 -070 is applicable) whose\nmembers are in the same industry, occupation or profession, or to a trust or to the\ntrustees of a fund established, created, or maintained for the benefit of members of\none (1) or more associations. The association or associations shall have:\n(a) At the outset a minimum of one hundred (100) persons;\n(b) Legally been in active existence for at least two (2) years;\n(c) A constitution and bylaws which provide that:\n1. The association or associations hold regular meetings not less than\nannually to further purposes of the members;\n2. Except for credit unions, the association or associations collect due s or\nsolicit contributions from members; and\n3. Members have voting privileges and representation on the governing\nboard and committees; and\n(d) Been organized and maintained in good faith for purposes other than that of\nobtaining insurance.\n(2) Charges co llected from the insured members or employees specifically for the\ninsurance, and the dues of the association if they include the cost of insurance, shall\nbe determined according to each attained age or in not less than four (4) reasonably\nspaced attained age groups. In no event shall the rate of such dues or charges be\nlevel for all members or employees regardless of attained age.\n(3) The policy shall be subject to the following requirements:\n(a) The policy shall insure members of the association or associ ations, employees\nthereof or employees of members, or one (1) or more of the preceding, or all\nof any class or classes thereof for the benefit of persons other than the\nemployee's employer;\n(b) The premium for the policy shall be paid from funds contribute d by the\nassociation or associations, or by employer members, or by both, or from\nfunds contributed by the covered persons, or from both the covered persons\nand the association, associations, or employer members;\n(c) Except as provided in paragraph (d) of this subsection, a policy on which the\npremium is not to be derived from funds contributed by the covered persons\nspecifically for the insurance shall insure all persons, except those who reject\nthe coverage in writing; and\n(d) An insurer may exclude or limit the coverage on any person for whom\nevidence of individual insurability is not satisfactory to the insurer.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17269","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"258bd58a5e2ba92bc4a3286223d1786a29d812b89b7846ad1edb456f1cd2d2b0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.16-070","next":"us-ky/krs-304.16-085"},"notice":"GroundRules: Original legal text.
