{"data":{"id":"us-ky/krs-304.16-085","jurisdiction":"us-ky","citation":"KRS 304.16-085","heading":"Dependents' coverage.","body":"(1) Insurance under any group life insurance policy issued pursuant to KRS 304.16-030\n(employee groups), KRS 304.16-050 (labor union groups), KRS 304.16-060 (trustee\ngroups), KRS 304.16 -070 (public employee groups), KRS 304.16 -080 (association\ngroups), and KRS  304.16-115 of this subtitle may be extended to insure the\ndependents, or any class or classes thereof, of each insured employee or member\nwho so elects in amounts in accordance with a plan which precludes individual\nselection. A \"dependent\" includes any of the following:\n(a) The husband or wife of the insured employee or member;\n(b) The insured employee's or member's child under eighteen (18) years of age;\n(c) The insured employee's or member's child age eighteen (18) years or older\nwho is:\n1. Unmarried;\n2. Supported either in whole or in part by the insured employee or member;\nand\n3. A full -time student at a school, college, university, or other accredited\neducational institution; or\n(d) A dependent child of an insured employee or other member of an insure d\ngroup which terminates coverage at a specified age, who is unmarried and\nincapable of self -sustaining employment because of a mental or physical\ncondition, if:\n1. The child was incapacitated prior to attainment of the age at which\ndependent coverage would otherwise terminate;\n2. The child is chiefly dependent upon the employee or member for support\nand maintenance;\n3. The insurance of the employee or member remains in force;\n4. The dependent child remains incapable of self -sustaining employment;\nand\n5. The insured employee or member submits proof of the dependent child's\nincapacity within thirty -one (31) days of the dependent's attainment of\nthe termination age.\n(2) Premiums for the insurance on the dependents may be paid by the group\npolicyholder, or by  the employee or member or by the group policyholder and the\nemployee or member jointly.\n(3) A husband or wife and dependents pursuant to this section shall have the same\nconversion right as to the insurance on his or her life as is vested in the employee or\nmember.\n(4) Notwithstanding the provisions of KRS 304.16 -180 (certificate; filing approval)\nonly one (1) certificate need be issued for each family unit if a statement concerning\nany dependent's coverage is included in the certificate.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40548","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"7d6aecb85e5c2b171e1b10fcd3acb867a1a2df07364eb698452a006e13b55b3b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.16-080","next":"us-ky/krs-304.16-090"},"notice":"GroundRules: Original legal text.
