{"data":{"id":"us-ky/krs-304.16-115","jurisdiction":"us-ky","citation":"KRS 304.16-115","heading":"Discretionary groups -- Requisite findings of commissioner.","body":"Group life insurance offered to a resident of this state under a group life insurance policy\nissued to a group, other than one described in KRS 304.16 -030, 304.16-040, 304.16-050,\n304.16-060, 304.16-070, or 304.16-080, shall be subject to the following requirements:\n(1) No group life insurance policy shall be delivered in this state unless the\ncommissioner finds that:\n(a) The issuance of the group policy is not contrary to the best interests of the\npublic;\n(b) The issuance of the group policy would result i n economies of acquisition or\nadministration; and\n(c) The benefits of the group policy are reasonable in relation to the premiums\ncharged;\n(2) No group life insurance coverage may be offered in this state by an insurer under a\npolicy issued in another stat e unless this state or another state having requirements\nsubstantially similar to the requirements of subsection (1) of this section has made a\ndetermination that the requirements have been met;\n(3) The premium for the policy shall be paid either from the policyholder's funds or\nfrom funds contributed by the covered persons, or from both; and\n(4) An insurer may exclude or limit the coverage on any person as to whom evidence of\nindividual insurability is not satisfactory to the insurer.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40549","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"8fbad3577baeaf504ff3cd6440bf28343c70e8adccbc7a04aa90ddccb56f2ef3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.16-110","next":"us-ky/krs-304.16-120"},"notice":"GroundRules: Original legal text.
