{"data":{"id":"us-ky/krs-304.17-040","jurisdiction":"us-ky","citation":"KRS 304.17-040","heading":"Required provisions -- Captions -- Omissions -- Substitutions.","body":"(1) Except as provided in subsection (2) of this section, each such policy delivered or\nissued for delivery to any person in this state shall contain the provisions specified\nin KRS 304.17 -050 to 304.17 -160, inclusive, in the words in which the same\nappear; except, that the insurer may at its option, substitute for one (1) or more of\nsuch provisions corresponding provisions of different wording approved by the\ncommissioner which are in each instance not less favorable in any respect to the\ninsured or the beneficiary. Each such provision shall be preceded individually by the\napplicable caption shown, or, at the option of the insurer, by such appropriate\nindividual or group captions or subcaptions as the commissioner may approve.\n(2) If any such provision is in wh ole or in part inapplicable to or inconsistent with the\ncoverage provided by a particular form of policy, the insurer, with the approval of\nthe commissioner, shall omit from such policy any inapplicable provision or part of\na provision, and shall modify an y inconsistent provision or part of a provision in\nsuch manner as to make the provision as contained in the policy consistent with the\ncoverage provided by the policy.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17289","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"5e91d1691dd158c67b5fcc89c979a7094e6c52c4342e66a6db9c27f73940fe92","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-030","next":"us-ky/krs-304.17-042"},"notice":"GroundRules: Original legal text.
