{"data":{"id":"us-ky/krs-304.17-080","jurisdiction":"us-ky","citation":"KRS 304.17-080","heading":"Reinstatement.","body":"(1) There shall be a provision as follows:\n\"Reinstatement: If any renewal premium be not paid within the time granted\nthe insured for payment, a subsequent acceptance of premium by the insurer or by\nany agent duly authorized by the insurer to accept such premium, without requiring\nin connection the rewith an application for reinstatement, shall reinstate the policy:\nprovided, however, that if the insurer or such agent requires an application for\nreinstatement and issues a conditional receipt for the premium tendered, the policy\nwill be reinstated upo n approval of such application by the insurer or, lacking such\napproval, upon the forty -fifth day following the date of such conditional receipt\nunless the insurer has previously notified the insured in writing of its disapproval of\nsuch application. The r einstated policy shall cover only loss resulting from such\naccidental injury as may be sustained after the date of reinstatement and loss due to\nsuch sickness as may begin more than ten (10) days after such date. In all other\nrespects the insured and insur er shall have the same rights thereunder as they had\nunder the policy immediately before the due date of the defaulted premium, subject\nto any provisions indorsed hereon or attached hereto in connection with the\nreinstatement. Any premium accepted in conne ction with a reinstatement shall be\napplied to a period for which premium has not been previously paid, but not to any\nperiod more than sixty (60) days prior to the date of reinstatement.\"\n(2) The last sentence of the provision contained in subsection (1) of this section may be\nomitted from any policy which the insured has the right to continue in force subject\nto its terms by the timely payment of premiums (a) until at least age fifty (50) or, (b)\nin the case of a policy issued after age forty-four (44), for at least five (5) years from\nits date of issue.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17294","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"5e9a0e359138961d1daad073c85c998e9e230d0975c04da8884492392524d439","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-070","next":"us-ky/krs-304.17-090"},"notice":"GroundRules: Original legal text.
