{"data":{"id":"us-ky/krs-304.17-130","jurisdiction":"us-ky","citation":"KRS 304.17-130","heading":"Person to whom indemnity payable.","body":"(1) There shall be a provision as follows:\n\"Payment of Claims: Indemnity for loss of life will be payable in accordance with\nthe beneficiary designation and the provisions respecting payment which may be\nprescribed herein and effective at the time of payment. If no designation or\nprovision is then effective, any indemnity shall be payable to the estate of the\ninsured. Any other accrued indemnities unpaid at the insured's death may, at the\noption of the insurer, be paid either to a beneficiary or to the estate. All other\nindemnities will be payable to the insured.\"\n(2) Except as provided in KRS 304.17A -265 and 304.17C -137, the following\nprovisions, or either of them, may be included with the provision required under\nsubsection (1) of this section at the option of the insurer:\n(a) \"If any indemnity of this policy shall be payable to the estate of the insured, or\nto an insured or beneficiary who is a minor or otherwise not competent to give\na valid release, the insurer may pay such indemnity, up to an amount not\nexceeding $.... (insert an amount which sh all not exceed $5,000), to any\nrelative by blood or connection by marriage of the insured or beneficiary who\nis deemed by the insurer to be equitably entitled thereto. Any payment made\nby the insurer in good faith pursuant to this provision shall fully dis charge the\ninsurer to the extent of the payment.\"; and\n(b) \"Subject to any written direction of the insured in the application or otherwise,\nall or a portion of any indemnities provided by this policy on account of\nhospital, nursing, medical, or surgical services may, at the insurer's option and\nunless the insured requests otherwise in writing not later than the time of\nfiling proofs of the loss, be paid directly to the hospital or person rendering\nservices, but it is not required that the service be render ed by a particular\nhospital or person.\"","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56663","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"adf5ccb78676eecdd8c8eba4b1acedb40c307f90cbf34051052fc3aeb067c8a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-120","next":"us-ky/krs-304.17-140"},"notice":"GroundRules: Original legal text.
