{"data":{"id":"us-ky/krs-304.17-230","jurisdiction":"us-ky","citation":"KRS 304.17-230","heading":"Insurance with other insurers -- Other benefits -- \"Other valid","body":"coverage.\"\n(1) There may be a provision as follows:\n\"Insurance with Other Insurers: If there be other valid coverage, not with this\ninsurer, providing benefits for the same loss on other than an expense incurred basis\nand of which this insurer has not been given written notice prior to the occurrence\nor commencement of loss, the only liability for such benefits under this policy shall\nbe for such proportion of the indemnities otherwise  provided hereunder for such\nloss as the like indemnities of which the insurer had notice (including the\nindemnities under this policy) bear to the total amount of all like indemnities for\nsuch loss, and for the return of such portion of the premium paid a s shall exceed the\npro rata portion for the indemnities thus determined.\"\n(2) If the policy provision set out in subsection (1) of this section is included in a policy\nwhich also contains the policy provision set out in subsection (1) of KRS 304.17 -\n220, there shall be added to the caption of the foregoing provisions the phrase \"...\nOther Benefits.\"\n(3) The insurer may, at its option, include in the provision set out in subsection (1) of\nthis section, a definition of \"other valid coverage\" approved as to for m by the\ncommissioner, which definition shall be limited in subject matter to coverage\nprovided by organizations subject to regulation by insurance laws or by insurance\nauthorities of this or any other state of the United States or any province of Canada,\nand to any other coverage the inclusion of which may be approved by the\ncommissioner. In the absence of such definition such term shall not include group\ninsurance, or benefits provided by union welfare plans or by employer or employee\nbenefit organization s. For the purpose of applying the foregoing policy provision\nwith respect to any insured, any amount of benefit provided for such insured\npursuant to any compulsory benefit statute, including any workers' compensation or\nemployer's liability statute, whet her provided by a governmental agency or\notherwise, shall in all cases be deemed to be \"other valid coverage\" of which the\ninsurer has had notice.
