{"data":{"id":"us-ky/krs-304.17-310","jurisdiction":"us-ky","citation":"KRS 304.17-310","heading":"Family expense health insurance.","body":"(1) Family expense health insurance is that provided under a policy issued to one (1) of\nthe family members insured, who shall be deemed the policyholder, covering any\ntwo (2) or more eligible members of a family, including husband, wife, unmarried\ndependent children, to age nineteen (19), unmarried children from nineteen (19) to\ntwenty-five (25) years of age who are full-time students enrolled in and attending an\naccredited educational institution and who are primarily dependent on the\npolicyholder for maintenance and support, and any other person dependent upon the\npolicyholder. Any authorized health insurer may issue the insurance.\n(2) An individual hospital or medical expense insurance policy or hospital or medical\nservice plan contract delivered or issued f or delivery in this state more than 120\ndays after June 13, 1968, which provides that coverage of a dependent child shall\nterminate upon attainment of the limiting age for dependent children specified in the\npolicy or contract shall also provide in substan ce that attainment of the limiting age\nshall not operate to terminate the coverage of the child while the child is and\ncontinues to be both (a) incapable of self -sustaining employment by reason of an\nintellectual or physical disability and (b) chiefly dependent upon the policyholder or\nsubscriber for support and maintenance, provided proof of the incapacity and\ndependency is furnished to the insurer or corporation by the policyholder or\nsubscriber within thirty -one (31) days of the child's attainment of the  limiting age\nand subsequently as may be required by the insurer or corporation but not more\nfrequently than annually after the two (2) year period following the child's\nattainment of the limiting age.\n(3) Insurers offering family expense health insurance shall offer the applicant the option\nto purchase coverage for unmarried dependent children until age twenty-five (25).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17320","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"4da1a8f394fc6bbc4e67eb123d4f38f2285b78d514b22d2723b9511f3e765ce0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-305","next":"us-ky/krs-304.17-311"},"notice":"GroundRules: Original legal text.
