{"data":{"id":"us-ky/krs-304.17-312","jurisdiction":"us-ky","citation":"KRS 304.17-312","heading":"Definitions for KRS  304.17-313, 304.18-037, 304.32-280, and","body":"304.38-210.\nAs used in KRS 304.17-313, 304.18-037, 304.32-280, and 304.38-210:\n(1) \"Home  health agency\" means  a public agency or private organization, or a\nsubdivision of such an agency or organization which is licensed as a home\nhealth agency by the Kentucky Health Facilities and Health Services Certificate\nof Need and Licensure Board and is certified to participate as a home  health\nagency under Title XVIII of the Social Security Act;\n(2) \"Home  health care\" means the care and treatment provided by a home health\nagency  which is prescribed and supervised by a physician, an advanced\npractice registered nurse, or a physician assistant. The care and treatment\nshall include but not be limited to one (1) or more of the following:\n(a) Part-time or intermittent skilled nursing services provided by an advanced\npractice registered nurse, registered nurse, or licensed practical nurse;\n(b) Physical, respiratory, occupational, or speech therapy;\n(c) Home  health aide services;\n(d) Medical appliances and equipment, drugs and medication, and laboratory\nservices, to the extent that such items and services would have been\ncovered under the policy if the covered person had been in a hospital;\nand\n(3) \"Home  health aide services\" means those services provided by a home health\naide and supervised by a registered nurse which are directed towards the\npersonal care of the patient. Such services shall include but not be limited to\nthe following:\n(a) Helping the patient with bath, care of mouth, skin, and hair;\n(b) Helping the patient to the bathroom or in using a bedpan;\n(c) Helping the patient in and out of bed and assisting with ambulation;\n(d) Helping the patient with prescribed exercises which the patient and home\nhealth aide have been taught by appropriate professional personnel;\n(e) Assisting with medication ordinarily self-administered that has been\nspecifically ordered by a physician, an advanced  practice registered\nnurse, or a physician assistant;\n(f) Performing incidental household services as are essential to the patient's\nhealth care at home  provided that such services would have been\nperformed if the patient was in a hospital or skilled nursing facility; and\n(g) Reporting to the professional nurse supervisor changes in the patient's\ncondition or family situation.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50731","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"0715033264fdc73b5406dce4ccb4dc85dc848e1f86ca5b7fe0aab8f1a1ece9e3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-311","next":"us-ky/krs-304.17-313"},"notice":"GroundRules: Original legal text.
