{"data":{"id":"us-ky/krs-304.17-390","jurisdiction":"us-ky","citation":"KRS 304.17-390","heading":"Franchise plan health insurance -- Franchise plan disability insurance.","body":"(1) Health insurance on a franchise plan is that issued to:\n(a) Five (5) or more employees of a common employer; or\n(b) Ten (10) or more members of any bona fide association or labor union, which\nassociation or union was formed and exists for purposes othe r than that of\nobtaining insurance, and under which such employees or members, with or\nwithout their dependents, are issued individual policies which may vary as to\namounts and kinds of coverage as applied for, under an arrangement whereby\nthe premiums on the policies are to be paid to the insurer periodically by the\nemployer, with or without payroll deductions, or by the association, or by\nsome designated employee or officer of the association acting on behalf of the\nemployer or association members.\n(2) Disability insurance on a franchise plan is that issued for:\n(a) Three (3) or more employees of a common employer; or\n(b) Ten (10) or more members of any bona fide association or labor union, which\nassociation or union was formed and exists for purposes othe r than that of\nobtaining insurance, and under which the employees or members, with or\nwithout their dependents, are issued individual policies which may vary as to\namounts and kinds of coverage as applied for, under an arrangement whereby\nthe premiums on t he policies are to be paid to the insurer periodically by the\nemployer, with or without payroll deductions, or by the association, or by\nsome designated employee or officer of the association acting on behalf of the\nemployer or association members.\n(3) The term \"employees\" includes also the employer's officers, and the employer or\npartners if the employer is an individual or a partnership.\n(4) An insurer may charge different rates, provide different benefits, or employ\ndifferent underwriting procedure for i ndividuals insured under a franchise plan, if\nsuch rates, benefits, or procedures as used do not unfairly discriminate as between\nindividuals insured under franchise plans and individuals otherwise insured under\nsimilar policies, taking into consideration the insuring, risk and exposure factors,\nand expense elements.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17341","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:45Z","sha256":"b1970ed8e78896112652af20f546dde87fb2804b906a1b6182a934a1bae14c42","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17-383","next":"us-ky/krs-304.17-400"},"notice":"GroundRules: Original legal text.
