{"data":{"id":"us-ky/krs-304.17a-008","jurisdiction":"us-ky","citation":"KRS 304.17A-008","heading":"Application of subtitle.","body":"(1) As used in this section, \"otherwise specifically indicated or provided\" means that\nthe section or another section of the Kentucky Revised Statutes:\n(a) Expressly states that the section is applicable to; and\n(b) Specifically refers to;\na type of insurance , coverage, or benefits that is excluded under subsection (2) of\nthis section.\n(2) Unless otherwise specifically indicated or provided, the sections of this subtitle\nshall not apply to or affect any of the following:\n(a) Policies, plans, certificates, or contracts covering only accident, credit, dental,\nvision, or specified disease, illness, or condition;\n(b) Disability income insurance;\n(c) Paid family leave insurance;\n(d) Long-term care insurance;\n(e) Short-term nursing home insurance;\n(f) Medicare supplement insurance;\n(g) Hospital indemnity or other fixed indemnity insurance;\n(h) Coverage provided under a limited health service benefit plan as defined in\nKRS 304.17C -010, including a limited health service contract as defined in\nKRS 304.38A-010;\n(i) Coverage under which benefits for medical expenses are:\n1. Contained in, or included as a rider, amendment, or supplemental policy\nprovision to, any liability insurance policy or contract or equivalent self -\ninsurance; or\n2. Supplemental to other insurance or equivalent self -insurance benefits,\nincluding the following:\na. Automobile medical-payment insurance; and\nb. Life insurance or endowment or annuity contracts;\n(j) Medical expense reimbursement coverage that is:\n1. Specifically designed to supp lement, or fill gaps in, primary health\ninsurance coverage; and\n2. Provided under a policy, plan, certificate, or contract that is separate\nfrom the primary health insurance coverage;\n(k) Coverage or benefits provided under:\n1. KRS Chapter 205 or 342; or\n2. Any other statutory-based public assistance or compensation program;\n(l) Coverage or benefits for on-site medical clinics;\n(m) Coverage or benefits provided under a health flexible spending arrangement;\nor\n(n) Other types of similar or limited insurance, coverage, or benefits, to the extent\nspecified by the commissioner in an administrative regulation promulgated in\naccordance with KRS Chapter 13A.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56190","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"3bcfc1720e7f012ec94d44da5eda85e5b8a67ee1fdaba5cc000708edd89cb51c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-005","next":"us-ky/krs-304.17a-010"},"notice":"GroundRules: Original legal text.
