{"data":{"id":"us-ky/krs-304.17a-139","jurisdiction":"us-ky","citation":"KRS 304.17A-139","heading":"Family or dependents coverage to apply to newly born child from","body":"moment of birth and to include inherited metabolic diseases -- Requirement\nfor notification and payment of premium -- Coverage for milk fortifiers to\nprevent enterocolitis.\n(1) A health benefit plan that provides coverage for a family or dependent shall provide\ncoverage of a newly born child of the insured from the moment of birth.\n(2) Coverage for a newly born child shall consist of coverage of injury or sickness,\nincluding the nece ssary care and treatment of medically diagnosed congenital\ndefects and birth abnormalities.\n(3) If payment of a specific premium or fee is required to provide coverage for a child,\nthe policy or contract may require that notification of birth of a newly bo rn child\nand payment of the required premium or fees must be furnished to the insurer\nwithin thirty -one (31) days after the date of birth in order to have the coverage\ncontinue beyond that thirty-one (31) day period.\n(4) (a) For the purposes of this subsection:\n1. \"Milk fortifier\" means a commercially prepared human milk fortifier\nmade from concentrated one hundred percent (100%) human milk; and\n2. \"One hundred percent (100%) human diet\" means the supplementation\nof a mother's expressed breast milk or donor milk with a milk fortifier.\n(b) A health benefit plan that provides prescription drug coverage shall provide\nthat coverage for a one hundred percent (100%) human diet, if the one\nhundred percent (100%) human diet and supplemented milk fortifier products\nare prescribed for the prevention of necrotizing enterocolitis and associated\ncomorbidities, and are administered under the direction of a physician.\nCoverage under this subsection may be subject to a cap of fifteen thousand\ndollars ($15,000) per infant, fo r each plan year, subject to annual inflation\nadjustments.\n(5) The requirements of this section shall apply to all health benefit plans delivered or\nissued for delivery on or after June 25, 2013.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42421","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:46Z","sha256":"03da6fea852fe46f9f7eaac1bb0164a364f07db9bcba1571e80b1a9142691d54","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.17a-138","next":"us-ky/krs-304.17a-140"},"notice":"GroundRules: Original legal text.
